Welcome to MerchStore.ie! By registering with our platform, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully. If you disagree with any part of the terms, you may not use our service.
Services Provided
MerchStore.ie offers a platform for artists and bands to sell merchandise directly to their fans. Our services include the on-demand production, order fulfilment, shipping, and customer service of merchandise. No merchandise exists until an order is placed by a customer.
Registration and Information
Artists and bands interested in using our services must provide accurate and complete information during the registration process. You are responsible for the accuracy of the information provided, including bank account details for payouts and content for merchandise production.
Content and Copyright
You grant MerchStore.ie a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display the content and artwork along with clips of your music as audio or video provided by you for the sole purpose of offering and selling your merchandise throughout our online platforms. Where audio is provided it will only be used for the promotion of your products and only your products.
You affirm that you own or have the necessary licenses, rights, consents, and permissions to use and to authorise MerchStore.ie to use all intellectual property pertaining to your merchandise.
Pricing and Payments
- MerchStore.ie will set retail prices for merchandise based on standard pricing models. Artists and bands will earn 20% of the revenue after VAT on each item sold.
- Payouts will be made quarterly, bi-annually or annually depending on the level of revenue generated per registrant. Payments will be transferred electronically to a bank account provided by the artist or band during registration.
Responsibilities
- MerchStore.ie is responsible for the on-demand production, quality control, packaging, shipping, and customer service of merchandise sold.
- Artists and bands are responsible for providing high-quality designs and accurate bank account details for payouts.
Termination
MerchStore.ie reserves the right to terminate our service to you and remove your merchandise from our platform at any time, without notice, for any breach of these Terms.
Limitation of Liability
MerchStore.ie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the service.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to use our service after those revisions become effective, you agree to be bound by the revised terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
